Legal modernisation in Vietnam - Barriers and recommendations

Abstract

The modernisation of the law to adapt to the context of globalisation, international integration, and the fourth industrial revolution is an objective requirement of many countries around the world. Each country will face different barriers in the process of modernising its legal system. In Vietnam, there are many barriers that have been causing difficulties for the process of legal modernisation. The article proposes a number of solutions to overcome those barriers, such as innovating legal thinking; identifying theories in legal scientific research and lawmaking; improving the legislative process; increasing financial and human resource investment in lawmaking; and establishing a mechanism to control and eliminate group interests in lawmaking.
