Abstract

Along with the development of science and technology as well as the process of socio-economic growth, there are more and more properties of material wealth and sentimental values that give rise to more new types of assets, including intellectual property – assets created as a result of human intellect. Intellectual property rights, as well as the interests arising from these right are often not as easily identifiable as the ordinary tangible properties. Therefore, when the owner of the intellectual property passes away, determining rights to intellectual properties as inheritance is a complicated matter. The article analyses and clarifies a number of legal and practical issues related to the identification of intellectual property rights as inheritance under Vietnamese law.
