Legal guarantee for detainees in Vietnamese criminal justice

Abstract

The main content of the article includes: (1) Analyzing the perspective of judicial reform to ensure human rights in criminal justice by clarifying legal basis of the Constitution and other laws, specifically the guarantee of procedural rights and basic rights for the detainees in political, civil, freedom and personal privacy rights for the detainees; (2) Clarifying some causes of abusing the detaining solutions in criminal justice in Vietnam; (3) Proposing solutions to improve some provisions of the 2015 Criminal Procedure Code and the 2015 Law on Enforcement of temporary custody and detention, following the guarantee of the rights for detainees.
