Inheritance rights of individuals born by In Vitro Fertilization - Canadian legal experience and recommendations for Vietnam
Abstract
The development of reproductive technologies has brought opportunities for parenthood to many couples and single women. In general, Vietnamese law has defined parental rights, thereby providing a basis for establishing the inheritance rights of individuals born by in vitro fertilization techniques. However, the legal framework to regulate the determination of a child’s parents in the case of a conception after the parent’s death as well as the child’s inheritance rights in this case is not clear enough. The analysis of current law, based on reference to Canadian legal experience, will contribute to perfecting the law on inheritance rights of individuals born by in vitro fertilization techniques in Vietnam today.
