Abstract

In the context of increasing demand for labor cooperation between Vietnam and China, comparative research on the law on the right to unilaterally terminate the labor contract between the two countries is important in protecting the rights of Vietnamese workers when working in China and vice versa. This article analyzes the similarities and differences in the employees’ right to unilaterally terminate the labor contract stipulated in Vietnam’s 2019 Labor Code and China’s 2008 Labor Contract Law and then proposes a number of recommendations to improve the law on Vietnamese employees’ right to unilaterally terminate the labor contract.
