“Assault to escape” in property theft and the case of crime transformation in the robbery

Abstract

According to the current Criminal Code, assault to escape constitutes an aggravating circumstance for criminal liability in the composition of some property infringement crimes, especially property theft. Due to its many legal similarities with the case of crime transformation in the robbery, the practical application of this circumstance remains challenging and prone to confusion. This article analyzes and comments on the distinct legal characteristics of assault to escape in property theft, comparing it to the case of crime transformation in the robbery, thereby providing a comprehensive and consistent understanding for legal practitioners.
