The right to request divorce under the 2014 Law on Marriage and Family from the perspective of protecting human rights

Abstract

The right to request divorce is a personal right associated with husband and wife. In the 2014 Law on Marriage and Family, in order to better ensure the rights of husband and wife, the provisions on the right to request divorce of parents and other relatives of one spouse have been added, and the case where the husband is restricted from requesting divorce has also been supplemented. However, certain shortcomings still arise when implementing these provisions in practice. The article analyzes the content, points out the limitations and proposes to improve the legal provisions on the right to request divorce to better ensure the human rights of related subjects.
