Abstract

This article examines the role and responsibilities of the French Public Prosecutor’s Office and the Chinese People’s Procuratorate in ensuring the Presumption of Innocence - a fundamental achievement of modern criminal procedure. Through an analysis of how prosecutorial authorities in France and China fulfill this responsibility at different stages of criminal proceedings, the paper highlights the key advantages and legislative achievements of both systems. It then draws lessons for Vietnam to improve its criminal procedure law and enhance the responsibility of the People’s Procuracy in ensuring this principle.
