Legal regulations of the Russian Federation on plea bargaining procedures - Experiences for Vietnam

Abstract

The criminal procedure model of the Russian Federation has demonstrated that plea bargaining has brought certain benefits in easing the workload of the judicial system; however, it also exposes significant concerns, particularly regarding transparency and the risk of coercion. This paper examines the legal framework and practical implementation of plea bargaining in the Russia, drawing insights to inform Vietnam’s ongoing criminal justice reform, including narrowly defining its scope, establishing robust judicial oversight, and safeguarding the rights of victims. Notably, the critical role of judges in approving plea agreements will be essential to ensuring the legitimacy of this procedure within Vietnam’s legal context.
