Sexual offenses against persons under 18 years of age – Obtacles and recommendations

Abstract

The 2015 Penal Code (amended and supplemented in 2017) has had provisions in accordance with International convention on the protection of persons under 18 years old against sexual abuse. The Judicial council of the Supreme People’s Court has issued Resolution guiding the application and adjudication cases of sexual abuse of persons under 18 years old. Despite of this legal basis for the application of law in prosecuting criminal liability for child sexual abuse crimes, it has remained a number of inadequacies in reality.
