Foundations to determine that a peson commits a crime “in the heat of passion”

Abstract

The heat of passion is an important content defined as a criminal circumstance in the Penal Code. However, that status does not have a general definition for evaluation which leads to different opinions and application. The article analyzes the foundations for assessing whether an act of inflicting damage is “in the heat of passion” or not.
