Exemptions from liability due to the participation of a third party in accordance with CISG 1980 and Vietnamese laws

Abstract

The article studies the provisions on exemptions from liability due to the participation of a third party in accordance with Vietnamese laws and the United Nations Convention on Contracts for the International Sale of Goods (Vienna, 1980 - CISG). By comparison with other sources of law, it also makes an assessment of the compatibility and advantages of the provisions of Vietnamese laws and CISG on this issue; thereby, proposes solutions to improve the law, towards the uniformity and professionalism in the judicial reform process.
