Foundations for regulating and applying death penalty under Vietnamese criminal laws and international trends on this matter

Abstract

There are many viewpoints on whether we should maintain the death penalty or not. It is not only a national issue but also a special concern of the criminal law of many countries around the world. Depending on the economic, political and social situation and the jurists’ viewpoints, each nation prescribes different regulations on that matter. The author analyzes the trend of the death penalty in some nations and the basis of the regulation and application of the death penalty in Vietnam. Therefore, from the author’s point of views, it is necessary to maintain the death penalty in the Penal Code currently.
