Some issues of the People’s Court’s jurisdiction to adjudicate matters of administrative cases

Abstract

Through many amendments, supplements and new promulgations, the current Law on Administrative Procedure has reached a certain perfection in terms of legislative technique and scope of regulation. However, the regulation on lawsuits under jurisdiction  of the People’s Court in Article 30 of the 2015 Law on Administrative Procedure (amended and supplemented in 2019) still has some shortcomings that have not been resolved in time or there are many different views. In this article, the author focuses on explaining and proposing a number of theoretical and legal issues surrounding the jurisdiction of the People’s Court to adjudicate matters of administrative cases.
