Vietnamese legal provisions on protecting a bona fide third party in invalid contractions of transferring land use rights and housing

Abstract

When it comes to dealing with legal consequences of the invalid contractions of transferring land use rights and housing, besides ensuring the rights and interests of the owner, the protection rights and interests of a bona fide third party should also be considered. The article provides an overview of the protection of a bona fide third party and evaluates the current legal provisions on protection of a bona fide third party in invalid contractions of transferring land use rights and housing. Thereby, the article gives some proposals and recommendations to improve the Vietnamese law on protection of a bona fide third party in invalid contractions of transferring land use rights and housing.
