Discussing some circumstances mitigating criminal liability in Vietnam Penal Code

Abstract

In Vietnam Penal Code, circumstances mitigating criminal liability are fully and clearly specified and have the potential to expand the range of options for courts to consider when deciding on penalties for offenders. However, during the application process, there have been many cases where the Court and the Procuracy have different opinions on the application of circumstances mitigating criminal liability. The article discusses a number of circumstances mitigating criminal liability that are widely applied in practice, thereby proposes some recommendations to improve the provisions in the Penal Code on that circumstances.
