Discussion on principles of fair trial in Vietnamese criminal procedures

Abstract

Fair trial is a procedural right, a principle and an important procedure studied by many domestic and foreign scholars. Despite of being recognized by the Vietnamese Criminal Procedure Code in Article 25 as a basic principle, fair trial is only in the form of a name without determining its content. The article clarifies the concept and content of the principle of fair trial in criminal procedures and makes proposals to improve the provisions of the 2015 Criminal Procedure Code on the principle of fair trial.
