Improving the regulations on the principle of fair trial in Vietnam’s criminal procedures

Abstract

Fair trial is an important value, principle and right in criminal proceedings. The implementation of fair trial principle contributes to ensuring the objectivity, accuracy, fairness and impartiality of the process of resolving criminal cases and is also a requirement to ensure human rights in criminal proceedings. Vietnamese law has initially recognized this principle in Article 25 of the 2015 Criminal Procedure Code. However, in reality, there are still many important contents of fair trial that have not been expressed or perfected. The article analyzes some common issues and then makes recommendations to improve the regulations on the principle of fair trial in criminal proceedings.
