Abstract

The accusatory function is a fundamental component of criminal procedure. Its existence and operation determine the existence and operation of other procedural functions. Research indicates that certain provisions of the current Vietnamese criminal procedure law on this function remain limited. In this article, the authors clarify several theoretical issues, analyze relevant legal provisions and propose orientations for improving the accusatory function in a manner that aligns with practice and the Communist Party of Vietnam’s viewpoint on continuing to build and perfect the socialist rule-of-law state in the new era.
