Restricting human rights and citizens rights in Vietnam: Constitutional principle and enforcement

Abstract

Principle of restricting human rights and citizens rights first stipulated at Clause 2, Article 14 and other amendments in the 2013 Constitution on human rights are considered as one of the most progressive points that contribute to making our Constitution closer to constitutionalism and international law. However, the enforcement of constitutional principle has not been fully implemented due to the lack of an effective constitutional protection mechanism and method to ensure proportionality between the damage of that limitation and the its benefits.
