LEGISLATION OF LABOR MEDIATORS IN RESOLVING INDIVIDUAL LABOR DISPUTES AND RECOMMENDATIONS

Abstract

A labor mediator works to resolve individual labor disputes in Vietnam. Many studies reveal that the provisions of The Vietnam Labour Code 2012 labor mediators in the settlement of individual labor disputes still remain several shortcomings related to the appointment authority; standards of labor mediators; mediation procedures; verification and collection of evidence documents; legal validity of successful mediation minutes. Based on analyzing the legal situation and the objective requirements of completing the law, the article proposes a number of recommendations to improve the legislation of labor mediators in resolving individual labor disputes such as: Establishing mediation centers and issuing labor mediator cards; raising standards of labor mediators; allowing voluntary mediation procedures; expanding the rights of labor mediators when verifying and collecting evidence documents... This study would be valuable for reference to improve the revised Labor Code Project of Vietnam today.
