THE HISTORICAL DEVELOPMENT OF PROPERTY LAW IN VIETNAM AND EMERGING ISSUES FOR PROPERTY LAW IN THE CONTEXT OF SUSTAINABLE DEVELOPMENT
Abstract
The Vietnamese legal system is organized according to the Civil Law model, similar to many countries in this system, such as France, Germany, and Japan. Property law provisions are considered one of the main pillars and are often codified in the Civil Code. After Vietnam reunified in 1975, the country promulgated its first Civil Code in 1995. Subsequently, in 2005, a new Civil Code was enacted to replace the 1995 version. Responding to the demands of practical life, Vietnam issued a new Civil Code in 2015 to replace the previous one, and it is currently in effect. This article focuses on analyzing the development process of property law provisions to highlight the changes in the legislation perception and the practical demands for legal provisions. The article provides an in-depth analysis to argue that Vietnam’s property law should continue to be revised and improved to meet the requirements of sustainable development, an essential demand for all nations in the current era.
