REGULATIONS ON GENDER MAINSTREAMING IN THE LAW-MAKING PROCESS AND PROPOSED RECOMMENDATIONS
Abstract
Integrating gender equality issues into the process of drafting legal documents is considered an important solution, a basis for comprehensively and substantially addressing gender and equality issues. The Law on the Promulgation of Legal Documents 2015, amended and supplemented in 2020, also identifies gender impact assessment as one of five the contents that need to be considered when formulating policies and drafting legal documents. Although the work of integrating gender equality issues is assessed to have made increasing progress, there are still some difficulties and shortcomings, especially at the local level. This paper reviews legal regulations related to the integration of gender equality issues in the process of drafting legal documents, especially the process of the People’s Council and People’s Committee at the provincial level, discovering limitations, inadequacies, and policy gaps, thereby making recommendations for continued improvement to contribute to improving the effectiveness of integrating gender equality issues in drafting legal documents.
