Law on the annulment of commercial arbitral awards

Abstract

This article analyzed and evaluated the legal provisions on the annulment of commercial arbitral awards, beginning with an examination of the concept of annulment and the fundamental indicators for identifying such activity. It then distinguished and clarified two activities with many easily confusing similarities: “annulment of a commercial arbitral award” and “refusal to recognize a foreign arbitral award.” By conducting an analysis and assessment, including a comparison with practical enforcement, the article pointed out certain shortcomings and inadequacies in the current legislation governing the annulment of commercial arbitral awards. Subsequently, the authors proposed recommendations for improving the legal framework in this area in Viet Nam.
