Completing the exemption policy for research and development agreements
Abstract
The exemption policy for anti-competitive agreements is one of the major and important contents of the regulations controlling anti-competitive agreements. In the course of operation, when manufacturing and trading enterprises want to survive and develop, they must conduct research and development activities of new products. However, the costs of research and development, especially creating breakthrough products, are often huge. On the other hand, investment in research and development often has a high probability of failure. High costs and high risks are some of the challenges of research and development. This paper analyzed the nature of research and development agreements, the purpose and significance of exemption policies for anti-competitive agreements on research and development, and relevant aspects of Vietnam's competition law based on reference to relevant experience from the United States and European Union's competition laws. From those analyses, assessments and recommendations for the improvement of this regulation in the current condition of Vietnam were made.
