The international experience in the sea dispute settlement under the 1982 UNCLOS and some implications to Vietnam

Abstract

Dispute over territorial sovereignty, sovereignty rights, jurisdiction over lands and seas has been increasingly complex and tense. The sea dispute settlement by peaceful means under the 1982 UNCLOS has become the most comprehensive method of the current sea dispute settlement mechanisms. The paper presents the theoretical basis for identifying crucial forms of sea dispute and cases of maritime dispute between countries in different regions in the world. Therefore, the article clarifies sea dispute settlement mechanisms under UNCLOS and makes necessary suggestions for Vietnam in the context of dispute in the East Sea with hidden threats.
