Intellectual Property Rights Protection in the Trans-Pacific Partnership Agreement and Its New Version

Abstract

Intellectual property rights (IPR) protection is one of the important matters in new generation free trade agreements such as Trans-Pacifi c Partnership Agreement (TPP) among 12 Pacifi c-rim countries and  Comprehensive and Progressive Agreement for Trans-Pacifi c Partnership (CPTPP) involving 11 countries in the Pacifi c region. These international standards of IPR protection, which are more severe than those under the  Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) among all member nations of the World Trade Organization (WTO), will set forth new obligations for developing member countries, including Vietnam. This paper introduces TPP and CPTPP requirements for IPR protection.
