Some limitations and inflammations in the Regulations law regarding probation and recommendation to improver the law

Abstract

The issue of probation has been regulated from Article 24 to Article 27 of the Labor Code 2019 and its implementing documents. From there, it has created a legal basis for the parties in establishing and implementing probation agreements. However, the practical application showed that the regulations on probation still had some points that were not really suitable and were still in conflict with related regulations, so it is necessary to continue to study to propose solutions to improve. Within the scope of this article, the author analyzes and clarifies the limitations and shortcomings and proposes recommendations to improve the legal regulations on probation.
