POLICY ON DATA CREATION, MANAGEMENT, AND USE IN THE CONTEXT OF DIGITAL GOVERNMENT DEVELOPMENT IN VIETNAM
Abstract
Digital data is not only a medium for conveying information but also a crucial tool for state governance, decision-making support, and enhancing the quality of public services. Therefore, the establishment of a legal and policy framework for the creation, management, sharing, and preservation of digital data has been identified as a core task in the process of developing a digital government in Vietnam. This article focuses on analyzing and systematizing current policies and legal regulations related to digital data. It employs legal document analysis and literature systematization methods to clarify the concept, characteristics, and functions of digital data, thereby assessing the legal status quo, identifying policy gaps, and proposing recommendations for improvement. Digital data is defined to include various forms such as text, images, audio, and video, represented by digital signals with features such as easy storage, editable formats, and rapid transmission. The management of digital data requires rigorous control mechanisms in technical, operational, and legal aspects. Based on the analysis, the article proposes several policy orientations, including: refining the legal definitions and classifications of digital data; establishing a centralized and interoperable management mechanism across government agencies; strengthening data storage and protection capabilities; and, importantly, promoting the role of citizens as active stakeholders in the digital data ecosystem. These recommendations aim to enhance the effectiveness of data governance, foster comprehensive digital transformation, and build a citizen-centric digital government.
