LEGALITY OF THE LETTER OF THE LATE PRIME MINISTER PHAM VAN DONG SENT CHINA ON SEPTEMBER 14TH 1958.

Abstract

              To assert the unauthorized sovereignty over Hoang Sa and Truong Sa archipelagoes, China cited false letter of the late Prime Minister Pham Van Dong sent China on September 14th 1958. In his letter, the prime minister did not mention one word about China’s territories, the Hoang Sa and Truong Sa archipelagoes, so it has no legal value for the two archipelagoes. To prove this, the author has analysed clearly the circumstance, the historical significance of the letter and the conditions of the estoppel principle.
